What do the honorable scholars say regarding the following issue: A person migrated from his village to the city in order to earn a livelihood. He continued to send monthly expenses to his parents back home, and apart from these expenses, he gradually saved some amount for himself. From these accumulated savings, he purchased a house. The question is: Will his brothers have any share in this house or not? Will this house be included in his father’s estate (inheritance), or will it be regarded as his personal property? Kindly provide complete guidance on this matter. May Allah reward you with goodness.
In the given case, if the mentioned person purchased the said house by saving and accumulating money from his own personal earnings, then that house will be regarded as his exclusive property. Legally, under Shariah, neither his father nor his other brothers and sisters will have any share in it, nor will they have the right to claim any ownership or share in that house.
کما في ردالمحتار : لا يجوز لأحد من المسلمين أخذ مال أحد بغير سبب شرعي الخ(باب التعزیر، ج 4، ص 61، ط: سعید)۔
وفی بدائع الصنائع: وأما بیان حکم الملک والحق الثابت فی المحل فنقول وباللہ التوفیق حکم الملک ولایۃ التصرف للمالک فی المملوک باختیارہ لیس لاحد ولایۃ الجبر علیہ الا لضرورۃ ولا لاحد ولایۃ المنع عنہ وان کان یتضرر بہ الا إذا تعلق بہ حق الغیر فیمنع عن التصرف من غیر رضا صاحب الحق وغیر المالک لا یکون لہ التصرف فی ملکہ من غیر إذنہ ورضاہ الا لضرورۃ وکذلک حکم الحق الثابت فی المحل اذا عرف ھذا فنقول للمالک أن یتصرف فی ملکہ أی تصرف شاء سواء کان تصرفا یتعدی ضررہ الی غیرہ أو لا یتعدی الخ(کتاب الدعوی، فصل بیان حکم الملک والحق الثابت الخ، ج 6، ص 264، ط: سعید)۔
