Being adamant in not distributing the inheritance

We, five siblings, want to sell our late father's flat and distribute the share to all the heirs as per Sharia, including our mother, and also to arrange a suitable residence for our mother. Is it right to do so? Also, if despite all these things, our mother says that she will not let us sell the house, what will be the ruling as per the Sharia?

الجوابُ حامِدا ًو مُصلیِّا ً

It should be known that, distribution of inheritance should be done as soon as possible, and one should think about getting rid from this responsibility, so as to avoid any chance of any kind of resentments, disagreements, clashes, or loss of someone's rights, later. Therefore, in the case mentioned, if all siblings are willing to distribute the inheritance, the mother should not be an obstacle to this, but rather should think about relieving from this duty by distributing the share allotted in Sharia to each heir from the inheritance.

مأخَذُ الفَتوی

کما فی مشکاۃ المصابیح: وعن أنس قال : قال رسول الله صلى الله عليه و سلم : " من قطع ميراث وارثه قطع الله ميراثه من الجنة يوم القيامة " . رواه ابن ماجه اھ ( ج 2 ص 197 )۔
وفیہ ایضاً: "عن سعيد بن زيد قال: قال رسول الله صلى الله عليه وسلم: «من أخذ شبراً من الأرض ظلماً؛ فإنه يطوقه يوم القيامة من سبع أرضين اھ".(باب الغصب والعارية، ج:1، ص:254، ط:قديمي)۔
وفی الدر المختار : (و قسم) المال المشترك (بطلب أحدهم إن انتفع كل) بحصته (بعد القسمة و بطلب ذي الكثير إن لم ينتفع الآخر لقلة حصته) و في الخانية: يقسم بطلب كل و عليه الفتوى ، لكن المتون على الأول فعليها العول (و إن تضرر الكل لم يقسم إلا برضاهم) لئلا يعود على موضوعه بالنقض. (ج6،ص 260،ط:سعید)-
