What do the respected muftis say regarding the issue that our brother has passed away, and his heirs include a widow, a daughter, two brothers, and a sister. How will his estate be divided according to Sharia law?
The estate of the deceased brother of the petitioner shall be distributed among his heirs in accordance with the principles of inheritance in such a way that whatever movable and immovable property, gold, silver, jewelry, cash and all kinds of small and large household appliances the deceased left in his possession at the time of death shall be the estate of the deceased and out of this, the average expenses of the deceased's burial should be paid first. Then, if he has any debts or has not paid the widow's dowry, they should be paid. Then, if the deceased has made any valid will, it should be carried out to the extent of one-third (1/3) of the remaining property. After that, whatever remains should be divided into (40) shares, out of which (5) shares should be given to the deceased's widow, (20) shares to the daughter, (6) shares to each brother, and (3) shares to the sister.
