What do the muftis say about the issue that our father passed away in 2023, he owned some land which has to be divided among the heirs, the heirs include the deceased's widow, five sons, and four daughters, in what proportion will the deceased's inheritance, including the land, be divided among these heirs? And how much share does each of them get? Please provide an answer in the light of the Quran and Sunnah.
It should be known that the estate of the questioner’s deceased father will be distributed among his existing heirs according to the principle of inheritance, as follows.
Whatever movable and immovable property, gold, silver, jewelry, cash and all kinds of small and large household appliances the deceased left in his possession at the time of death, is the estate of the deceased, in which the average expenses of the deceased's burial should be paid first, then the deceased debts, if any or the widow's dowry due, they should be paid, and if the deceased has made any valid will, it should be carried out to the extent of one-third (1/3) of the remaining property. After that, whatever remains should be divided into a total of sixteen (16) equal shares, out of which the widow should be given two (2) shares, each son should also be given two (2) shares, and each daughter should be given one (1) shares.
