Respected Mufti Sahib, Assalamu Alaikum! What does the respected scholars say about the following issue that some time ago, a boy committed theft, but we had no knowledge of it. He brought the stolen money and gave it to another person as a loan. That person also did not know that the money was stolen. Now it has become known. If the money is returned to its rightful owners, the matter will become very complicated and may even reach the police station.
Therefore, we wish to know what should be done with this money. The person who committed the theft is not at all willing to take back the money.
The debtor should repay this loan to the lender, and it is obligatory upon the lender (the one who committed the theft) to return this amount to the rightful owner, either without disclosing the matter of theft or by stating it as a gift or something similar. It is not necessary to inform him about the theft itself; what is necessary is simply to ensure that his property (money) reaches him.
ففي الدر المختار: (ويبرأ بردها ولو بغير علم المالك) في البزازية غصب دراهم إنسان من كيسه ثم ردها فيه بلا علمه برئ وكذا لو سلمه إليه بجهة أخرى كهبة اھ (6/ 182)۔
وفي الفتاوى الهندية: والسبيل في المعاصي ردها وذلك هاهنا برد المأخوذ إن تمكن من رده بأن عرف صاحبه وبالتصدق به إن لم يعرفه ليصل إليه نفع ماله إن كان لا يصل إليه عين ماله اھ (5/ 349)۔
