When returning Dirhams obtained, on a later date, what is the rate applicable to repay?

What do the respected Ulama and learned Muftis say about the following issue: A person named Noor Syed had borrowed Dirhams from his nephews in Dubai for some work in 2016. At the time of giving it, he had not specified whether he would return the Dirhams or Pakistani currency. Now they are demanding return of the Dirhams from Noor Syed, whereas at that time the purchase price of the Dirham was twenty-eight Pakistani rupees, and now it is around 75 or 77. In this case, will Noor Syed return the money to his relatives as in the first case, i.e. 28 rupees, or at the current rate? Please give a clear answer with details. At the time of giving it, he had not specified whether he would give the return amount in the form of dirhams or in Pakistani currency.

الجوابُ حامِدا ًو مُصلیِّا ً

It should be clear that it is mandatory and necessary to repay the loan in the same currency in which the loan was taken or in another currency according to the current market rate with the consent of the parties at the time of repayment of the loan. Therefore, the borrower is now obligated to repay the same amount of Dirhams to his nephews as the amount of Dirhams that he borrowed from his nephews in 2016. Due to fluctuations in the value of the currency, it will not be permissible for the borrower to reduce or increase the repayment of the loan. However, if the borrower and the borrower's nephews agree to repay the loan in Pakistani rupees instead of Dirhams, then in such a case, it will be mandatory and necessary for the borrower to repay the loan in Pakistani currency according to the current market rate of Dirhams.

مأخَذُ الفَتوی

کما في رد المحتار: تحت ( قوله فلاعبرة لغلائه و رخصہ) فيه أن الكلام في الكساد، و هو ترك التعامل بالفلوس و نحوها( إلى قوله) و إن استقرض دانق فلوس أو نصف درهم فلوس ، ثم رخصت أو غلت لم يكن عليه الا مثل عدد الذي أخذه الخ (فصل في القرض ، ج5 ص 170 ، ط : سعید)-
وفي بدائع الصنائع : قولهما أن الواجب في باب القرض رد مثل المقبوض (إلى قوله) أن رد المثل كان واجباً و الفائت بالكساد ليس الا وصف الثمنية و هذا وصف لا تعلق لجواز القرض به الخ (كتاب القرض ، ج ۷ ص ۳۹ ، ط : سعید)-
وفي الفتاوى الهندية : والقرض هو ‌أن ‌يقرض ‌الدراهم والدنانير أو شيئا مثليا يأخذ مثله في ثاني الحال، والدين هو أن يبيع له شيئا إلى أجل معلوم مدة معلومة كذا في التتارخانية. (الباب السابع والعشرون في القرض والدين، ج 5، ص 566، ط : دار الفكر، بروت)-
