A man has a house. Another man occupies it illegally, and sells it to a third person, who does not know that it is illegal. Now the second man disappears from the scene. The first man demands that his house be returned to him. The third man says, "Pay the money I spent to buy it, and take the house." The first man is not ready for this. If the third man keeps the house, will he be punished on the Day of Judgment in this struggle? I have heard that the land that is occupied illegally will be hung around the neck of the occupant on the Day of Judgment.
If the house in question is actually owned by the first person, and he has legal documents and witnesses for it, then the sale of it by the second person is legally invalid, and the third person does not become its owner by purchasing it in this way. He must return the property to the original owner and receive his money from the seller. If the third person keeps the house for himself, he will undoubtedly be guilty of sin.
ففی الدر المختار: (والأصح أنه) أي العقار (يضمن بالبيع والتسليم) اھ (6/ 187)۔
وفی شرح المجلة: والأصح أن الامامین یوافقان محمدؒ بالضمان فی مسئلتین غیر الثلاث المذکورات الأولیٰ إذا باع الغاصب العقار وسلمه فأنه یضمنه یکون البیع والتسلیم استھلاکاً اھ (۳/ ۴۳۹)۔
وفیھا أیضاً: لو شری أرضا فبنی او زرع اھ (إلی قوله) ولو کان البائع غائبا والمستحق آخذا المشتری یھدم بنائه فقال المشتری غرنی بائعی وھو غائب قال أبوحنیفةؒ لا یلتفت إلی قول المشتری فیؤمر بھدمه وتدفع الدار إلی المستحق اھ (۲/ ۴۶۲) واللہ أعلم بالصواب!
