Ruling on trade and cultivation of opium, cannabis and hashish

What do the learned scholars and muftis say about the issue? Is opium cultivation is legally permissible? The second question is, what is the ruling on its use in general, is it legally permissible or not? Please let me benefit with the correct answer.

الجوابُ حامِدا ًو مُصلیِّا ً

The trade and cultivation of opium, cannabis and hashish have been declared completely unlawful by Hazrat Imam Abu Yusuf and Imam Muhammad. Especially since their legitimate use is almost non-existent at this time and the government has also imposed a ban on their trade and cultivation, it is obligatory to follow the government's legitimate prohibition and violating it is unlawful and a sin. Therefore, the trade, use and cultivation of opium and hashish etc. are not permissible according to Sharia law, and it is necessary to completely avoid them. However, if an expert physician advises the use of opium for treatment of a specific disease and there is no other useful and effective alternate treatment and medicine for that disease, in such a case its use is permissible according to Sharia law, otherwise, in any case, its use must be avoided.

مأخَذُ الفَتوی

ففي الدر المختار: (وصح بيع غير الخمر) مما مر، ومفاده صحة بيع الحشيشة والأفيون. (6/ 454)۔
وفي حاشية ابن عابدين: (قوله وصح بيع غير الخمر) أي عنده خلافا لهما في البيع والضمان، لكن الفتوى على قوله في البيع، وعلى قولهما في الضمان إن قصد المتلف الحسبة وذلك يعرف بالقرائن، وإلا فعلى قوله كما في التتارخانية وغيرها. ثم إن البيع وإن صح لكنه يكره كما في الغاية اھ (6/ 454)۔
وفي الفقه الإسلامي وأدلته: يحرم كل ما يزيل العقل من غير الأشربة المائعة كالبنج والحشيشة والأفيون، لما فيها من ضرر محقق، ولا ضرر ولا ضرار في الإسلام، (إلی قوله) ويحل القليل النافع من البنج وسائر المخدرات للتداوي ونحوه؛ لأن حرمته ليست لعينه، وإنما لضرره اھ (7/ 437)۔
