Taking increased price for selling vehicles on installments

Assalamu Alaikum!
Dear Mufthi Sahib, we have a very important problem. Sir, the problem is that we have been doing vehicle business since long. We buy a vehicle in cash for at least 80 thousand and give it in long installments. We take payment of 20 thousand for the vehicle and sell it forward on installments for three years and by the time, its total price paid reaches to one hundred and fifty thousand and sometimes it reaches to one hundred and sixty thousand (double). Is this manner permissible or not? If it is not permissible, then in what conditions can it be permissible? Jazakallah

الجوابُ حامِدا ًو مُصلیِّا ً

Selling a vehicle in installments in such a way that its price is determined at the time of sale, and it is also determined how long these installments will last, and how much money must be paid per installment, and that no additional amount is charged if the installment payment is delayed due to some compulsion, etc. So selling in installments in this way is undoubtedly permissible and correct, and not otherwise.

مأخَذُ الفَتوی

ففي المبسوط للسرخسي: وإذا عقد العقد على أنه إلى أجل كذا بكذا وبالنقد بكذا أو قال إلى شهر بكذا أو إلى شهرين بكذا فهو فاسد لأنه لم يقاطعه على ثمن معلوم ولنهي النبي صلى الله عليه وسلم عن شرطين في بيع وهذا هو تفسير الشرطين في بيع ومطلق النهي يوجب الفساد في العقود الشرعية وهذا إذا افترقا على هذا فإن كان يتراضيان بينهما ولم يتفرقا حتى قاطعه على ثمن معلوم وأتما العقد عليه فهو جائز لأنهما ما افترقا إلا بعد تمام شرط صحة العقد اھ (13/ 13)-
