Taking increased price for selling on installments

Respected Mufti Sahib!
Assalamu Alaikum wa rahmatullahi wa barakatuhu!
I am very grateful to you for answering my question. According to this answer, I would like to ask another question: is it permissible in Islam to buy something in installments, while the seller charges a lower price for a total spot payment and a higher price for payment in installments? Isn't it usury that you pay more in installments? Your quick response will be greatly appreciated, because I will be waiting for your guidance. I will act according to your instructions.

الجوابُ حامِدا ًو مُصلیِّا ً

It is permissible and correct according to Sharia to charge a higher price in the case of selling on credit or installments compared to cash, and this does not fall under the category of usury, but in the case of dealing with installments, the following conditions must be observed:
(1): It should be decided in the contract meeting itself that this matter is on credit and installments.
(2): That the total installments will be so much, for example ten.
(3): That each installment will have such an amount.
(4): If any installment is delayed for any reason, no penalty should be imposed on it.
So, if these conditions are observed, any matter regarding installments will be permissible and correct according to Sharia law.

مأخَذُ الفَتوی

ففي الفقه الإسلامي وأدلته للزحيلي: قال الحنفية: البيع فاسد؛ لأن الثمن مجهول، لما فيه من تعليق وإبهام دون أن يستقر الثمن على شيء: هل حالاً أو مؤجلاً. فلو رفع الإبهام وقبل على إحدى الصورتين، صح العقد اھ (5/ 3460)۔
وفي المبسوط لشمس الدين السرخسی: العقد على انه إلى أجل كذا بكذا وبالنقد بكذا أو (قال) إلى شهر بكذا (إلی قوله) وهذاإذا افترقا على هذا فان كان يتراضيان بينهما ولم يتفرقا حتى قاطعه على ثمن معلوم وأتما العقد عليه فهو جائز لانهما ما افترقا الا بعد تمام شرط صحة العقد. (6/ 13)۔
وفي الهداية شرح البداية: ويجوز البيع بثمن حال ومؤجل إذا كان الأجل معلوما لإطلاق قوله تعالى ﴿وأحل الله البيع ﴾ اھ (3/ 22)۔
وفي الدر المختار: (وصح بثمن حال) وهو الأصل (ومؤجل إلى معلوم) لئلا يفضي إلى النزاع اھ (4/ 531)۔
وفي حاشية ابن عابدين: (قوله: لئلا يفضي إلى النزاع) تعليل لاشتراط كون الأجل معلوما؛ لأن علمه لا يفضي إلى النزاع اھ (4/ 531)۔ واللہ أعلم بالصواب!
