The administrators of an educational institute, upon giving admission to students, request them to sign a deed on which all of the institute’s rules and regulations are written. Also written on this deed are conditions which include: If a student is absent from class, doesn’t pray Namaz in Jama’at, or break other rules, then a fine will be imposed upon him. This fine is only imposed for the student’s rectification. Is imposing this fine upon the student permissible as per Shari’ah? Where can this money be used?
It is not permissible as per Shari’ah to impose a fine upon the students for breaking the rules and regulations of a Madrasa/Educational Institute, or for not being punctual in performing Namaz with Jama’at. However, if an amount were to be taken from the students temporarily in order to make them punctual in following the rules and performing Namaz in Jama’at, and given back to then after admonition, then this will be permissible.

کما فی مجمع الأنھر: وفی البحر ولا یکون التعزیر بأخذ المال من الجانی فی المذھب لکن فی الخلاصۃ سمعت عن ثقۃ أن التعزیر بأخذ المال إن رأی القاضی ذلک، أو الوالی جاز۔ اھـ (ج١، ص٦٠٩)
وفی رد المحتار: والحاصل أن المذھب عدم التعزیر بأخذ المال، وسیذکر الشارح فی الکفالۃ عن الطرسوسی أن مصادرۃ السلطان لأرباب الأموال لا تجوز إلا لعمال بیت المال أی إذا کان یردھا لبیت المال الخ۔ اھـ (ج٤، ص٦٢) واللہ اعلم بالصواب
