Assalaamualaikum, What do the respected Ulama and the reverend Mufties say about this i.e, Some of the Madrasa people decide with the traders well before the days of Qurbani that the skin of the slaughtered animal would be sold to them on an agreed price. Is it correct to do transactions like this? Does this fall within the ruling of Bai e Ma'doom (Sale of unavailable item) or just a promise to sell? If this is a promise to sale what would be the ruling in Shari'a for breaking the promise?

Finalizing transactions as mentioned here is not a sale but a promise to sale and it is a sin to renege unnecessarily from a promise, hence it is essential to refrain from it.

و فی حاشیۃ الچلبی: ( ولاینعقد بلفظین احدھما الماضی والاٰخر بلفظ المستقبل) وانما لاینعقد بذالک لأن النبی ﷺ استعمل فیہ لفظ الماضی الذی یدل علی تحقق وجودہ فکان الانعقاد مقتصرا علیہ ولان لفظ المستقبل ان کان من جانب البائع کان وعدا لابیعا وان کان من جانب المشتری کان مساومۃ وقیل ھذا اذا کان اللفظان أو احدھما مستقبلا بدون نیۃ الایجاب فی الحال واما اذا کان المراد ذالک فینعقد البیع الخ (5/307)۔
