Will marriage be valid if someone gives false information

Will marriage be valid if someone gives false information about himself (i.e. about his age, employment etc.)?

الجوابُ حامِدا ًو مُصلیِّا ً

False information about one’s age will not have any effect on marriage. But with regards to employment, if one had given false information at the time of marriage to make himself seem compatible, and after marriage it became apparent that he is in reality incompatible, then the girl and her guardians can terminate the marriage as soon as they come to know of his incompatibility, but not afterwards.

مأخَذُ الفَتوی

فی الھدایۃ: النکاح ینعقدبالإیجاب و القبول بلفظین یعبربھما عن الماضی(۲/ ۳۰۵)
و فی الھندیۃ: أن المرأة إذا زوجت نفسها من رجل ولم تشترط الكفاءة ولم تعلم أنه كفء أو غير كفء ثم علمت أنه غير كفء لا خيار لها ولكن للأولياء الخيار، وإن كان الأولياء هم الذين باشروا عقد النكاح برضاها ولم يعلموا أنه كفء أو غير كفء فلا خيار لواحد منهما وأما إذا شرط الكفاءة أو أخبرهم بالكفاءة ثم ظهر أنه غير كفء كان لهم الخيار(۱/ ۲۹۳)۔ و اللہ اعلم بالصواب
