Getting commission after giving one's official stamp to another

I am an MBBS doctor, I have given my stamp to a traffic officer, so that he can place the stamp on the medical fitness certificate and give me a commission for it. Medical fitness is necessary for a driving license and my friend passes the fitness of those who are normal only. Is it permissible for me to take a commission from him? In such a case, the public is also benefitted

الجوابُ حامِدا ًو مُصلیِّا ً

It should be known that granting permission to use one's stamp for medical fitness is not something that can be given on rent or on commission, but rather it is a certification and permit that is given by the government to the relevant person after completing the required educational course and acquiring the skills. Therefore, this action of the questioner and taking a commission for it are not permissible, as both are prohibited by law and Sharia, which must be avoided.

و فی صحیح مسلم: عن أبي هريرة أن رسول الله صلى الله عليه وسلم مر على صبرة طعام فأدخل يده فيها، فنالت أصابعه بللا فقال: «ما هذا يا صاحب الطعام؟» قال أصابته السماء يا رسول الله، قال: «أفلا جعلته فوق الطعام كي يراه الناس، من غش فليس مني» (1/99)۔
كما في بحوث فى قضايا فقهیۃ معاصرة: هل يجوز لحامل رخصة الإيراد او الإصدار أن يبيع هذه الرخصة إلى تاجر آخر؟ (الى قوله) ولكن كل ذلك انما ياتي اذا كان في الحكومة قانون يسمح بنقل هذه الرخصة الى رجل آخر اما اذا كانت الرخصة باسم رجل مخصوص أو شركة مخصوصة ولا يسمح القانون بنقلها الى رجل آخر أو شركة أخرى فلا شبهة فى عدم جواز بيعها لأن بيعها يؤدي حينئذ إلى الكذب والخديعة فان مشترى الرخصة يستعملها باسم البائع لا باسم نفسه فلا يحل ذلك الا بأن يوكل حامل الرخصة بالبيع والشراء اھ(115/1)
