Ruling on Assuming Ihram for Those Traveling from Jeddah to Makkah

Assalamu Alaikum, Sir, I am a Pakistani citizen working in Jeddah, Saudi Arabia. Sometimes friends come from Pakistan for ʿUmrah, and we go to Makkah to meet them. In such a situation, can we go to Makkah without being in Ahram, just to meet friends or for other purposes? Or is it mandatory to enter Ahram and perform ʿUmrah?

الجوابُ حامِدا ًو مُصلیِّا ً

It should be understood that those who reside outside the Miqat, whenever they intend to enter Makkah—whether with the intention of Hajj or ʿUmrah, or for any other purpose—they are, according to the Hanafi school, obliged to assume Ihram from the Miqat every time, and performing ʿUmrah becomes mandatory. However, if a person resides within the Miqat and outside the Haram, and wishes to go to Makkah for any purpose without the intention of ʿUmrah, then assuming Ihram is not obligatory for him. In the present case, since the questioner’s residence is within the Miqat, if he goes to Makkah only to meet his friends and does not intend ʿUmrah, then it is not necessary for him to assume Ihram.

مأخَذُ الفَتوی

كما في الهندية : ومن كان داخل الميقات كالبستاني له أن يدخل مكة لحاجة بلا إحرام إلا إذا أراد النسك فالنسك لا يتأدى إلا بالإحرام ولا حرج فيه كذا في الكافي وكذلك المكي إذا خرج إلى الحل للاحتطاب أو الاحتشاش ثم دخل مكة يباح له الدخول بغير إحرام (الباب الثاني في المواقيت ،ج:١،ص: ٢٢١،مط:ماجدية)
وفي التاترخانية: ومن كان اهله في الميقات او داخل الميقات جاز له دخول مكة بغير احرام لحاجة من الحوائج (الفصل الرابع في مواقيت الاحرام،ج:٣،ص: ٥٥١،مط:رشيدية)
وفي الدر المختار: ( وحرم تأخير الإحرام عنها ) كلها ( لمن ) أي لآفاقي ( قصد دخول مكة ) يعني الحرم ( ولو لحاجة ) غير الحج
وفي رد المحتار تحت قوله : ( وحرم الخ ) فعليه العود إلى ميقات منها وإن لم يكن ميقاته ليحرم منه وإلا فعليه دم سيأتي بيانه في الجنايات قوله ( غير الحج ) كمجرد الرؤية والنزهة أو التجارة فتح (كتاب الحج،ج:٢،ص:٤٧٧،ناشر:ايچ ایم سعید)
