Ruling on doing business in tobacco and employment in a tobacco company

What do scholars say about engaging in business in tobacco? If a person works in a tobacco manufacturing company, what will be the Shariah status of his job and, what will be the Shariah status of the wages received in return for this job? If a person buys tobacco from a landowner for this company, and the company sets a wage for this work, then what will be the Shariah status of this?

الجوابُ حامِدا ًو مُصلیِّا ً

The buying and selling of tobacco and all the other matters mentioned are permissible according to Sharia, provided that no unlawful or impermissible act is committed during this time. Otherwise, a full explanation may be sent again for a comprehensive Sharia ruling in this regard.

مأخَذُ الفَتوی

ففي الدر المختار: والتتن الذي حدث وكان حدوثه بدمشق في سنة خمسة عشر بعد الألف اھ (6/ 459)۔
وفي حاشية ابن عابدين: (قوله والتتن إلخ) أقول: قد اضطربت آراء العلماء فيه، فبعضهم قال بكراهته، وبعضهم قال بحرمته، وبعضهم بإباحته، (إلی قوله) وأقام الطامة الكبرى على القائل بالحرمة أو بالكراهة فإنهما حكمان شرعيان لا بد لهما من دليل ولا دليل على ذلك فإنه لم يثبت إسكاره ولا تفتيره ولا إضراره، بل ثبت له منافع، فهو داخل تحت قاعدة الأصل في الأشياء الإباحة اھ (6/ 459) ۔واللہ أعلم!
