Engaging in Interest Based Transactions with Non-Muslims in Darul-Harb (Territory of War)

1-Is it allowed anywhere in the world to take interest from warring Kafirs in a territory of War or not?
2-And the surplus amount paid to a warring Kafir by a Muslim for the borrowed loan is Interest or no?

الجوابُ حامِدا ًو مُصلیِّا ً

In the name of Allah, the Most Beneficent and the Most Merciful
According to the decisive decree, it is not allowed in Shari’ah for a Muslim to engage in interest based transactions with a non-Muslim, whether they are in an Islamic state, a Non-Islamic state where the Muslims and non-Muslims are at peace, or a territory of War. Therefore, situation mentioned in the question does indeed fall under this ruling. Hence it is necessary to avoid and refrain from engaging in the aforementioned transaction.

مأخَذُ الفَتوی

ففی مشكاة المصابيح: وعن عمر بن الخطاب رضي الله عنه إن آخر ما نزلت آية الربا وإن رسول الله صلى الله عليه وسلم قبض ولم يفسرها لنا فدعوا الربا والريبة. رواه ابن ماجه والدارمي اھ (2/ 860)۔
وفی مشكاة المصابيح: وعن أبي هريرة قال: قال رسول الله صلى الله عليه وسلم: «الربا سبعون جزءا أيسرها أن الرجل أمه» اھ (2/ 859)۔
وفی الدر المختار: ولا بين حربي ومسلم) مستأمن ولو بعقد فاسد أو قمار (ثمة) لأن ماله ثمة مباح فيحل برضاه مطلقا بلا غدر خلافا للثاني والثلاثة. (5/ 186) والله أعلم بالصواب
