I have been working with a person for 25 years, and I owe him 5.8 million rupees, which he is asking for. We have a house with shares to all brothers. My mother is often sick, and 15 to 20 thousand rupees are spent for medicine every month. Now my son is getting married. I asked this person for a loan, but the amount he gives does not meet my needs. He is giving less. Can he cooperate with me in terms of Zakat or not? If he can, how much Zakat can he give me? What is she Sharia ruling in this regard?
If the questioner is in fact a debtor of fifty eight (58) lakh rupees and after deducting this amount of debt, he does not have in his possession any other asset equal to the Nisab of Zakath, i.e. seven and a half Tolas of gold, or fifty-two and a half Tolas of silver, or any other asset equal to its value, then in such a case, it is permissible and correct for the questioner's employer to cooperate with the him in payment of Zakat and for the questioner to use that amount for his own use. By doing so, the employer’s Zakath also is executed while the owner has the option to give the questioner as much Zakat as he wants, keeping in mind the need of the deserving person. It is Makruh to give a deserving person so much Zakat that he himself becomes the owner of the Zakath Nisab. However, it is definitely not appropriate to include unnecessary and non-Shar’i customs and traditions in the name of marriage and ask for assistance from benefactors in the name of Zakat etc. to fulfill these needs. Rather, doing so will be as if destroying and abusing the rights of actually deserving and needy people, which should be avoided.
کما قال اللہ تعالی: إِنَّمَا ٱلصَّدَقَٰتُ لِلۡفُقَرَآءِ وَٱلۡمَسَٰكِينِ وَٱلۡعَٰمِلِينَ عَلَيۡهَا وَٱلۡمُؤَلَّفَةِ قُلُوبُهُمۡ وَفِي ٱلرِّقَابِ وَٱلۡغَٰرِمِينَ وَفِي سَبِيلِ ٱللَّهِ وَٱبۡنِ ٱلسَّبِيلِۖ فَرِيضَةٗ مِّنَ ٱللَّهِۗ وَٱللَّهُ عَلِيمٌ حَكِيمٞ الایۃ(التوبہ،آیۃ60)۔
وفی الھندیۃ: (ومنها الغارم) وهو من لزمه دين، ولا يملك نصابا فاضلا عن دينه أو كان له مال على الناس لا يمكنه أخذه كذا في التبيين. والدفع إلى من عليه الدين أولى من الدفع إلى الفقير كذا في المضمرات الخ(1 /188)۔
وفی الدر المختار: (وكره إعطاء فقير نصابا) أو أكثر (إلا إذا كان) المدفوع إليه (مديونا أو) كان (صاحب عيال) بحيث (لو فرقه عليهم لا يخص كلا) أو لا يفضل بعد دينه (نصاب) فلا يكره فتح الخ(2 /353)۔
وفی رد المحتار:تحت (قوله: وكره إعطاء فقير نصابا أو أكثر) وعن أبي يوسف لا بأس بإعطاء قدر النصاب وكره الأكثر؛ لأن جزءا من النصاب مستحق لحاجته للحال والباقي دونه معراج وبه ظهر وجه ما في الظهيرية وغيرها عن هشام قال: سألت أبا يوسف عن رجل له مائة وتسعة وتسعون درهما فتصدق عليه بدرهمين قال: يأخذ واحدا ويرد واحدا الخ(2 /353)۔
