Can I give Zakaat to my maternal grandmother

Can I give Zakat ti my maternal grandmother who is severely old and ill and has no money, property or source of income?

الجوابُ حامِدا ًو مُصلیِّا ً

It is now permissible for the questioner to give Zakat to his maternal grandmother. The questioners Zakat will not be valid. But is she is needy, then the questioner should assist her through any other means other than Zakat (like charity, providing her with things she needs etc.).

مأخَذُ الفَتوی

(من بينهما ولاد) ولو مملوكا لفقير (أو) بينهما (زوجية) ولو مبانة وقالا تدفع هي لزوجها. (2/ 346)
وفي حاشية ابن عابدين: (قوله: وإلى من بينهما ولاد) أي بينه وبين المدفوع إليه؛ لأن منافع الأملاك بينهم متصلة فلا يتحقق التمليك على الكمال هداية والولاد بالكسر مصدر ولدت المرأة ولادة وولادا مغرب أي أصله وإن علا كأبويه وأجداده وجداته من قبلهما وفرعه وإن سفل اھ (2/ 346)
وفى النهر الفائق: (و) لا يدفع أيضا إلى (أصله) من الآباء والأمهات (وان علام ذلك الأصل كالأجداد والجدات من قبلهما (من قبلهما (و) لا إلى (فرعه) ولده ومنه في هذا الباب المخلوق من مائه بالزنى والذي نفاه احتياطا (وإن سفل) بضم الفاء كالأولاد لأن منافع الأملاك بينهم متصلة فلم يتحقق التمليك على الكمال ومن ثم منع من كل صدقة واجبة كالفطر والنذور والكفارات أما التطوع فيجوز بل هو الأولى كما في (البدائع) اھ (1/462).
