do perform their Namaz with risen voices which could be heard

Assalamu Alaikum! I wish to ask a question. Some people here, do perform their Namaz with risen voices which could be heard by the one who stands besides and tends to forget in his Namaz. Is it permissible or should it be performed silently so that the one stands besides could not hear? Awaiting your reply.

الجوابُ حامِدا ًو مُصلیِّا ً

It is permissible without doubt to raise the voice to the extent that the voice reaches the ear of one who recites. However it is not at all permissible to recite in a voice which will create disturbance in the Salath of one who stands beside. Therefore it is indeed necessary for them to abandon this undesirable practice.

مأخَذُ الفَتوی

ففی حاشیة الطحطاوی: (والمنفرد بفرض مخیر فیما یجهر) فإن شاء جهر لأنه إمام نفسه لکن لا یبالغ فی الجهر مثل الإمام لأنه لا یسمع غیره اھ (ص: ۱۳۸)
وفی الفتاوى الهندية: وكذا يجهر في التراويح والوتر إن كان إماما وإن كان منفردا إن كانت صلاة يخافت فيها يخافت حتما هو الصحيح وإن كانت صلاة يجهر فيها فهو بالخيار والجهر أفضل ولكن لا يبالغ مثل الإمام؛ لأنه لا يسمع غيره. كذا في التبيين اھ (1/ 72)
