Disclosing one's intention of charity

When giving someone charity, must it be disclosed to them that you are giving to them as charity? There are a lot of people who are in need but they dislike that you mention to them that you are giving charity to them. They say to give in the name of empathy, not as charity.

الجوابُ حامِدا ًو مُصلیِّا ً

It is not necessary to disclose to someone that you are giving them with the intention of charity. It is enough that one carries the intention of charity in his heart, especially if the one you are giving would take offence if you mention it to him.

مأخَذُ الفَتوی

کما فی قولہ تعالٰی: ﴿ان تبدو الصّدقات فنعمّاہی وان تخفوہا وتؤتوہا الفقراء فہو خیر لکم ویکفّر عنکم من سیّاٰتکم﴾ (البقرۃ: آیت: ۲۷۱)
وفی صحیح مسلم: عن ابی ہریرۃ عن النبیﷺ قال سبعۃ یظلہم اللہ فی ظلہ یوم لا ظل الّا ظلہ (الی قولہ) ورجل تصدق بصدقۃ فاخفاہا حتی لا تعلم یمینہ ما تنفق شمالہ الخ (۱/ ۳۳۱)
وفی رد المحتار: تحت (قولہ نیۃ) أشار إلی أنہ لا اعتبار للتسمیۃ فلو سماھا ہبۃ أو قرضا تجزیہ فی الأصح (۲/ ۲۶۸)
وفی الفقہ الاسلامی وادلتہ: لا حاجۃ لا علام الفقیر بکون المدفوع لہ ہوالزکاۃ. (۲/ ۸۹۹) واللہ اعلم بالصواب
