Ruling on the Government’s Order to Kill Stray Dogs

The Government of Punjab has issued an order to kill stray dogs. Most dogs are indeed stray, but many of them do not cause harm to anyone, while some do bite people. Many people also keep dogs at home. Is it permissible to keep dogs at home? Please guide us, O respected Muftis, regarding killing dogs in the light of the Qur’an and Hadith.

الجوابُ حامِدا ًو مُصلیِّا ً

It should be clearly understood that killing a non-harmful animal without any valid reason is not permissible. However, if an animal is harmful, then there is Shariah-based permission to kill it in order to protect people from its harm. Therefore, if such stray dogs are causing harm within human populations and there is no alternative to killing them in order to prevent their harm and suffering, then they may be killed. Even in such a case, a method should be adopted that causes them the least possible pain.

مأخَذُ الفَتوی

کما في صحيح المسلم عن عبد الله، أن رسول الله صلى الله عليه وسلم قال: «عذبت امرأة في هرة سجنتها حتى ماتت فدخلت فيها النار لا هي أطعمتها وسقتها، إذ حبستها، ولا هي تركتها تأكل من خشاش الأرض» اهـ ( ج 4 ص : 1760)
وفي مشكاة المصابيح وعن عائشة - رضي الله عنها - عن النبي - صلى الله عليه وسلم قال: " «خمس فواسق يقتلن في الحل والحرم الحية، والغراب الأبقع والفأرة، والكلب العقور والحديا» اهـ (ج: 2 ص 68)
وفي الفتاوى الهندية الهرة إذا كانت مؤذية لا تضرب ولا تعرك أذنها بل تذبح بسكين حاد كذا في الوجيز للكردري اهـ ( 5 ص : 361)
