A person who is in need to have a bath to become purified, made Tayammum and became purified, due to non- availability of water, and prayed a Salath as well. Subsequently water became available. Now, does he have to take a bath and perform Qadha Salath?
Let it be cleared that, if a person performs Salath with Tayammum, subject to the conditions to the validity of Tayammum, then his Salath is considered as to be performed correctly. Subsequently if water is made available it is not necessary to repeat the Salath. However if Tayammum was made instead of having bath (GHUSL), then with the availability of water, which is sufficient to take bath, his Tayammum becomes nullified. In which case it is obligatory as per Shari’a to take bath and get purified. Or else, his Salath henceforth, will not be valid without it.
فی مصنف ابن أبي شيبة: عن الحسن، أنه قال في متيمم مر بماء غير محتاج إلى الوضوء فجاوزه، فحضرت الصلاة وليس معه ماء، قال: «يعيد التيمم، لأن قدرته على الماء تنقض تيممه الأول» اھ (1/ 176)۔
وفی الفتاوى الهندية: ينقض التيمم كل شيء ينقض الوضوء كذا في الهداية وينقضه القدرة على استعمال الماء الكافي الفاضل عن حاجته. كذا في البحر الرائق. (إلی قوله) والأصل فيه أن كل ما منع وجوده التيمم نقض وجوده التيمم وما لا فلا. كذا في البدائع اھ (1/ 29)۔
