If someone does Wafq of his house

If someone does Wafq of his house, does the neighbors get the right of Shuf’ah?

الجوابُ حامِدا ًو مُصلیِّا ً

If someone does Waqf of his house his neighbors does not get the right of Shuf’ah, because a monetary transaction is necessary in order for the right of Shuf’ah to be established, which did not take place in this case.

مأخَذُ الفَتوی

ففی الھندیۃ:’’ و منھا عقد المعاوضۃ و ھو البیع أو ما ھو بمعناہ، فلایجب الشفعۃ بما لیس ببیع و لابمعنی البیع حتی لاتجب بالھبۃ و الصدقۃ و المیراث و الوصیۃ‘‘۔(۵/۱۶۰)
